STATE LAW NICKNAMES /NAME CHANGE





see that you are running again, but you have again used a "nickname" of Legalize Marijuana....which was the same tactic that got you thrown off the ballot last election season. So, you know Shine is going to raise the issue again, which means you will have to either defend against the ACEB or get kicked off the ballot again. David...I know you do this to be amusing, but its not funny.

Having said that though....interestingly you may have a case now that "legalize marijuana" is no longer a political statement but a nickname. You've had it on the ballot before. Shine's publically rejecting it and the news media reporting it has gotten people talking about it and referring to you as Mr Legalize Marijuana or that legalize marijuana guy. So now the question becomes at what point do words become a nickname and who decides when a nickname becomes a nickname and who decides what criteria gets used for such a purpose? Its not very clear cut. If I were you, I would go to the license bureau and see if they will update your license or ID card to include your full name. They may not as a full legal name does not normally include a nick name. If they won't update your ID, proving the existence of a nickname....which is not a legal name....then how can the ACEB prove or disprove a nickname for election purposes. Then the matter gets appealed before Judge Felts. If you take it that far, you have two choices: (1) appeal the ACEB decision straight up or (2) file paperwork to have you name legally changed to include your nickname and at the same time as for Judge Felts to recuse himself, which can be done if Hardin is the attorney representing the ACEB again...the recusal buys you some time. Another option is to begin the process right now of having your name legally changed (assuming the DMV won't let you update your license/ID with your nickname).
